1. Terms

By accessing the website at http://www.35clcocktail.com, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, we reserve the right to refuse service to anyone for any reason at any time. All deliveries, services and information provided shall be done in accordance to 35cl Beverage Concept Inc. (35cl Cocktail Co.)'s terms and conditions. The materials contained in this website are protected by applicable copyright and trademark law.

2. Age Restrictions

By agreeing to the Terms and Services, you (customer accessing the website) declare that you are of legal drinking age in the Philippines (18 or above) and are purchasing only for those of legal drinking age within the Philippines.

3. Purchases

35cl Cocktail Co. is a beverage company that aims to explore the boundaries of flavors through bottled cocktails. Purchases made on this website are only for the personal use of the consumer. Re-sale, commercial purposes, or any other commercial benefits are prohibited. Additionally, no products from 35cl Cocktail Co. may be used for any illegal or unauthorized purposes. We reserve the right to not accept your order if we are unable to obtain authorization for your payment. We strive to keep your orders as well as payments as secure as we can, however, in the case of third party unauthorized access to any customer data, we will not be held responsible for any loss on your side.

4. Products and Packaging

The images of each product on our website are for illustration purposes only. Although we have made reasonable efforts to display the appearance of each product accurately, we cannot guarantee that your computer or mobile device's display will accurately reflect the appearance of that product. The product which we deliver to you may vary slightly from the images on our website. Each product will come in a box with an information card with a description of the product. These will be packed in the best possible condition before shipping.

All products (bottled cocktails) are made with commercially known alcohol companies. 35cl Beverage Concept Inc. does not produce or distill their own spirits. Ingredients used may range from liquors, liqueurs, sweeteners, fruit juices, spices, and other food-grade items (e.g. citric and malic acid solutions). Different processes and methods are used to stabilize the shelf life of the products such as the usage of food-grade acids, filtration through the clarified milk punch method, steeping into alcohol, and other types of infusions. These are not to change the alcoholic contents of a spirit but to enhance the flavor of the cocktail. All bottled cocktails are made with methods and processes used within the food and beverage industry (specifically bars). 35cl Beverage Concept Inc. does not manufacture their own spirits and only uses products manufactured legally.

Products may contain small amounts of fine particles settling at the bottom of the bottle. These are present due to the nature of the ingredients and are not an indicator of spoilage. Swirling the bottle before pouring will properly redistribute these particles

The tasting notes on the website and packaging are written by our own tasting team. However, these are still subjective depending on the drinker's palate, as every person will have a different experience with the beverage. The tasting notes only serve as a guide towards describing the product and are no means an indicator regarding the overall quality of the said product.

5. E-commerce Platform

35cl Beverage Concept Inc. (35cl Cocktail Co.) utilizes Squarespace as its E-commerce platform with Paypal as the main mode of payment. All orders regarding the sale of our products are processed with these companies. All information required by Squarespace and Paypal are necessary within the ordering process to properly produce and deliver the products requested.

6. Prices

All prices reflected on the site are already inclusive of tax (3% Non-VAT). Each order, however, will require an additional freight cost of P150 to be shouldered by the customer. The additional delivery charge will only be added per receipt and not in addition to every product ordered. All prices are subject to change at any time.

7. Payment Options

All payments made through the website of 35cl Beverage Concept Inc. (35cl Cocktail Co.) will be processed through Squarespace and Paypal. If a customer were to prefer a secondary option of payment, a bank transfer option through Banco de Oro may be found on this page.

Please allow at least one business day to process your order for the bank transfer method. Our business hours are from Monday to Friday (10:00AM - 05:00PM, GMT+8). A request sent regarding a purchase through the bank transfer method is not an assurance of purchase for their requested product. In addition, the availability of a product presented on the site is not an indicator for this. A confirmation must first be sent before your product may be reserved and produced for your purchase. 35cl Beverage Concept Inc. has the right to refuse the reservation or payment of your product for any reason including the lack of availability of your said product and the preemptive payment of a product before confirmation has been received by the customer.

8. Delivery

Delivery for the product will be accomplished by either Transportify, Lalamove, or Mr. Speedy. These will be delivered to addresses only within Metro Manila on the same day it has been shipped. Each product will come in a box with an information card regarding the product ordered. 35cl Beverage Concept Inc. will pack each of the products in the best condition possible before having it shipped through these third party providers. Any minor damages caused by Grab, Lalamove, or Mr. Speedy including minimal tearing, small chipping, unintentional folding, and visible creasing will not be liable to 35cl Beverage Concept Inc.. Major damages caused by shipping, which warrants eligibility for return or refund (please see section 10), must be reported with pictures of said product at help@35clcocktail.com to be assessed by the company.

9. Cancellation Policy

Each product is made as you order and is processed once payment is received during business hours. Orders made through the website and through bank transfer will be produced once an e-mail confirmation has been sent. If a customer wishes to make a cancellation for any reason, this must be done before an order confirmation e-mail has been sent for the product to not be produced by sending us an email at help@35clcocktail.com. A cancellation charge of P30 (to be deducted from the total refunded amount) will be paid by the customer if a refund will be given. Any cancellations requested after confirmation will not be entertained and the customer will not receive a refund.

Any requests for changes to be made to an order will be treated as a cancellation. The customer should send an email to help@35clcocktail.com before receiving their order confirmation email. We will cancel your order for you and you will have to place another order through our website. Any transactions involving credit card payments will incur a P30 service charge, which will be deducted from the total refundable amount. Any requests for changes made after receiving the confirmation email will not be entertained.

10. Returns and Refunds Policy

35cl Beverage Concept Inc. (35cl Cocktail Co.) is not liable for any minor damages caused by delivery (please see section 8). Major damages caused by or during delivery including huge crack/s on the bottle or significant spillage may warrant eligibility for return. Returns in this manner will be at the expense of the customer. Shipping costs will be shouldered by the customer to return the product to the company. For requests of returns or refunds due to shipping damages, the customer must first send the damaged product back to 35cl Beverage Concept Inc. before a refund or return may be processed. Any refunds requested for major damages caused by shipping will incur a refund charge of P30 (to be deducted from the total refunded amount). We are unable to issue store credit. All refunds will be issued through the same method used for payment.

Returns or refunds based on the following merits will not be accepted by the company unless explicitly agreed to by an authorized representative of 35cl Beverage Concept Inc.:

dissatisfaction from the taste of the product
inability to taste the described tasting notes
slight color variation from posted/printed pictures from the actual product
presence of fine particles at the bottom of the bottle
damage or contamination done by the consumer
tampering of the packaging or the product done by external causes
damages done outside the context of production
minor superficial differences and other changes caused by external variables

Products that include production-related contamination such as large particles formed without the tampering of the product may be eligible for a return or a refund. Taste-related concerns will not be eligible merits for return unless the product displays extreme bitterness, extreme sourness, or tastes that may pose as a health hazard. These must be reported immediately to the company through help@35clcocktail.com with pictures of the said, untampered product within 3 days of the shipping date. Once approved, the said product must also be returned to the company before receiving a refund. The customer is responsible for all expenses in conjunction with the return.

11. Website Use License

Permission is granted to temporarily download one copy of the materials (information or software) on 35cl Beverage Concept Inc.'s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

modify or copy the materials;
use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
attempt to decompile or reverse engineer any software contained on 35cl Beverage Concept Inc.'s website;
remove any copyright or other proprietary notations from the materials; or
transfer the materials to another person or "mirror" the materials on any other server.

35cl Beverage Concept Inc. shall not be held liable for any damage, loss, or expense due in full or in part arising out of or resulting from using the 35cl Cocktail Co. website or purchasing from the website or through bank transfer. In no event shall 35cl Beverage Concept Inc. be liable to the customer for any direct, indirect, incidental, or consequential damages arising out of or in any way related to the 35cl Cocktail Co. website, web content, or products being sold.

18. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the Philippines and you irrevocably submit to the exclusive jurisdiction of the courts in that country. We reserve the right to proceed with legal action should a violation of these terms warrant such a course of action.

These terms and conditions are effective from June 18, 2019.

Our website and e-commerce platform is hosted on Squarespace. All data and information provided for the purchase of a product is stored through Squarespace's database. These data which may include name, shipping address, email address, and billing information will not be shared in any manner unless demanded by the law. All data provided by the customer through the website will be protected by Squarespace and their services.

All payments through the website will be processed through Paypal. Information gathered through Paypal will not be shared in any manner to any entity unless demanded by the law.
